Fireworks Safety in StillWaters


After conversations with Sheriff Abbett, State Fire Marshal Ed Paulk, Assistant State Fire Marshal Scott        

Pilgreen, assistance from Former SWVF&R Fire Chief Joey Darby and surveys of StillWaters' property owners, 

Condo Association Boards and the Neighborhood Council, as well as a review of the Covenants; the SWRA 

Board adopted a policy to endorse, support, and distribute to property owners the State of Alabama 

Code concerning fireworks which states that it is unlawful to explode fireworks within 600 feet of a   



There has been much discussion on the topic of safety, which began at a meeting of the SWRA Board, and the 

Condo Association Boards shortly after one of the buildings at Sunset Point burned a year ago. That fire was not 

fireworks related however, it led to a discussion of fireworks. Also, over the New Year's holiday, the            

community experienced a fire or two caused by unauthorized fireworks use. For the safety of home & boat 

owners, and those living in wooded areas or around the golf courses, the SWRA Board strongly supports 

the fireworks ban per the Code of Alabama. Please respect our policy and support public safety. 


The Sheriff’s department is the proper enforcement authority for firework’s violations. 


Code of the State of Alabama - Section 8-17-222  

It shall be unlawful to offer for sale or to sell any fireworks to children under the age of 16 years unless 

companied by an adult or to any intoxicated or irresponsible person.   

Any person purchasing fireworks shall be required to show a valid driver’s license or state approved 

identification card. 

It shall be unlawful to explode or ignite fireworks within 600 feet of any church, hospital, asylum, pub- 

lic school, any enclosed building, or within 200 feet or where fireworks are stored, sold, or offered 

for sale. 

No person shall ignite or discharge any permissible articles of fireworks within or throw the same from 

a motor vehicle while within nor shall any person place or throw any ignited article of fireworks 

into or at such a motor vehicle, or at or near any person or group of people.
